SANDAKAN: Six Parti Warisan assemblymen from here voiced serious concern and deep disappointment over the Court of Appeal decision to allow a delay in enforcing the High Court of Malaysia ruling on Sabah’s right to 40 per cent of federal net revenue.
The six representatives — Calvin Chong (Elopura), Lisa Alban (Sungai Sibuga), Alias Sani (Sekong), Arunanarsin Taib (Gum-Gum), Alex Wong (Karamunting) and Alex Thien (Tanjong Papat) — said the postponement once again shows how Sabah’s rights continue to be delayed despite being recognised through the courts.

They said the situation cannot be allowed to drag on, as it involves a long-standing entitlement that has yet to be fully honoured.
“The earlier High Court ruling had clearly confirmed that the Federal Government failed to review Sabah’s special grant as required under Article 112D of the Federal Constitution,” they said.
Although the Court of Appeal allowed the delay on procedural grounds, they said Sabah’s rights should not be disputed or postponed any further.
“The Federal Government should not use appeals or any other reasons as an excuse to delay implementation.

“The 40 per cent revenue claim is not a new issue. It has dragged on for decades without a fair resolution. Repeated delays will only strengthen the perception of a political failure to uphold the spirit of the Malaysia Agreement 1963.”
They added that the State Government must take a clear, firm and consistent position, and use all available political and legal channels to ensure the Federal Government fulfils its obligations.
They also called for greater transparency, urging the State Government to keep the public informed about negotiation progress and actions taken, in order to rebuild public confidence.
