High Court judge Wong Siong Tung made the decision via Zoom after allowing preliminary objections raised by Ruddy and two other respondents against the election petition filed against them.
Harun, who filed the petition on Dec 23, 2025, named Ruddy, the returning officer for the Pitas constituency, and the Election Commission as the first, second and third respondents, respectively.
Wong ordered the petitioner to pay RM15,000 in costs to Ruddy and RM5,000 in costs to the second and third respondents.
Ruddy won the six-cornered fight for the Pitas seat with 5,754 votes and a majority of 1,565, while Harun garnered 4,189 votes in the 17th Sabah general election on Nov 29, 2025.
