LAHAD DATU: The Sessions Court here on Wednesday sentenced a man to 25 years’ jail plus 10 strokes of the cane for raping his niece.
Judge Suhailla Selag meted out the sentence to the man after he was found guilty of raping his niece, who was 15-year-old at that time in December 2020, at his house in Kunak.

He was convicted under Section 376(3) of the Penal Code which carries a jail term of between eight and 30 years, and whipping of at least 10 strokes, on conviction.
According to the fact of the case, the victim was put under the accused’s care due to the difficulties of the victim’s parents.
Prior to the incident, the victim was sleeping inside her room before the accused pulled her into his bedroom and raped her.
During the incident, the accused’s wife stayed over at her parent’s house, while the accused’s children were not aware of the incident.
After the incident, the accused apologised to the victim and asked her to not tell anyone, especially family members, about the incident.
Eight prosecution and five defence witnesses testified during the hearing.
Deputy Public Prosecutor Ng Juhn Tao appeared for the prosecution. The accused was represented by Counsel Abdul Gani Zelika and Counsel Mohd Ridwan Usman.
The Court granted the stay of execution pending his appeal and bail set at RM15,000 with one local surety.
