Man claims trial to keeping stolen motorcycle
The charge, under Section 411 of the Penal Code, carries a jail term of between six months and five years or with fine, or both, on conviction.
Kota Kinabalu: A man was charged in the Magistrate’s Court here Wednesday for keeping a stolen motorcycle.

Hussin Gedafi, 19, pleaded not guilty before Magistrate Marilyn Kelvin to keeping a stolen Modenas Kriss belonging to one Yusuf Abdullah on Jan 1, at 5.10pm, in the free zone behind a seafood restaurant at Putatan Trade Centre Street.

The charge, under Section 411 of the Penal Code, carries a jail term of between six months and five years or with fine, or both, on conviction.

The court fixed March 9 for pre-trial case management and released the accused on a bail of RM1,800 in two sureties.

Kartini Ahmad, 40, pleaded guilty to having RM2,000 belonging to one Liow Cheng Wee in her CIMB Bank account that she failed to satisfactorily explain, on June 18, 2024, at 2.38pm, here.

She was charged under Section 22A(1) of the Minor Offences Ordinance (Sabah Cap 80), which carries a maximum penalty of a RM100 fine, three months’ jail, or both.

The court heard from the prosecution that the complainant transferred RM2,000 into a bank account under Kartini’s name after responding to a Facebook advertisement for an IPad . 

The seller later turned out to be a scammer and the complainant felt cheated when she did not receive the iPad and her phone number was blocked.

Unrepresented, Kartini requested a lower fine, saying she came from Selangor and was taking care of his disabled husband.

The prosecution applied a deterrent sentence. 

In another case, 12 people were penalised for taking drugs.

Ahmad Danial, Al Sabri Abdul, Herman Barat, Markus Naku, Analisa Jafar, Norly Kadir, Chang Khun Ping, Rosli Matarol, Azhairul Abdul, Mamai Ibnu, Syukri Izudin and Adrian Jeterin pleaded guilty separately to committing the offence under Section 15(1) of the of the Dangerous Drugs Act.

The charge provides for a fine of up to RM5,000 or up to two years jail, on conviction.

Ahmad was sentenced to nine months’ jail, while Al Sabri, Herman, Mamai and Syukri were each handed eight months’ jail.

Analisa, Rosli and Azhairul were each jailed seven months, Markus, Norly and Adrian received six months’ jail each, while Chang was fined RM1,800 or six months’ jail.

The court also ordered Al Sabri, Herman, Analisa, Rosli and Mamai to be referred to the Immigration Department after serving their jail term.
