KOTA KINABALU: A company director was discharged and acquitted by the Sessions Court here on Wednesday after the prosecution failed to prove beyond a reasonable doubt two charges of criminal breach of trust (CBT) involving RM1.7 million.
Sessions Court Judge Elsie Primus ruled that the evidence fell short against 54-year-old Wong Kim Hing.

The first charge alleged Wong misappropriated RM1,507,574.80 of company funds between April 28 and Dec 29, 2021, while the second involved RM200,669 allegedly taken between July 22 and Sept 12, 2022.
The offences were framed under Section 409 of the Penal Code, which carries penalties of up to 20 years’ jail, whipping or a fine upon conviction, with seven prosecution and four defence witnesses called during the hearing.
Following the decision, the court ordered the return of Wong’s bail and passport, with Deputy Public Prosecutor Nurul Shaferrah Mad Iskim leading the prosecution and Datuk Ram Singh and Prem Elmer Ganasan appearing for the defence.
