Kota Kinabalu: A 29-year-old man, Sharul Nizam Roger Kan, who was initially scheduled for facts and sentencing on Wednesday, changed his plea and claimed trial to a charge of raping an underaged student.
Sessions Court Judge Amir Shah Amir Hassan set Jan 19, 2026 for pre-trial case management.
Sharul is accused of raping a 15 years and 11 months old girl at 5.45pm on Aug 31, 2024, at a hotel in Tuaran.
The offence, framed under Section 376(1) of the Penal Code, carries up to 20 years’ jail and whipping, upon conviction.
Sharul was ordered to remain in remand pending the next court date.
Deputy Public Prosecutor Bryan Francis appeared for the prosecution, while Sharul was unrepresented.
Meanwhile, a 33-year-old woman was fined a total of RM4,000 for committing several pharmacy-related offences.
Lisherine Ddyvie Jawan pleaded guilty to all three charges.
On the first charge, she was fined RM1,000 or one month’s jail for selling three unregistered products to a woman at 11.30am on June 15, 2023, at Aqualis Beauty and Fashion in Phase 3 Papar Commercial Centre, Papar.
On the second charge, she was fined RM1,500, in default one month’s jail, for possessing 11 unregistered products at the same time and place.
For the third charge, she was fined another RM1,500, or one month’s jail, for having 11 cosmetics without proper notification.
During mitigation, Lisherine appealed for leniency and pledged not to repeat the offence.
Pharmacy Prosecuting Officer Angeline Francis William appeared for the prosecution.
