Raping daughter: Indonesian gets 15 years and caning
The charge under Section 376(1) of the Penal Code carries a maximum penalty of 20 years’ jail and whipping, on conviction.
SANDAKAN: The Sessions Court on Tuesday sentenced a 36-year-old Indonesian man to 15 years’ jail and 10 strokes of the cane for raping his 14-year-old biological daughter last year.

Judge Rosalinda Razali handed down the sentence after the man pleaded guilty to committing the offence on April 27, 2025, at 10pm, in a worker house of a plantation in Kinabatangan.

The charge under Section 376(1) of the Penal Code carries a maximum penalty of 20 years’ jail and whipping, on conviction.

The court heard from the prosecution that on the said day, the victim was asleep in her room when the man entered and carried out the heinous crime.

The man also threatened the victim not to tell anyone, warning he would beat her if word on the incident got out.

The victim eventually confided in her uncle, a plantation security guard, at around noon on Nov 10, 2025, who then informed the plantation supervisor for further action.

On the same day, the victim and her uncle lodged a police report at the Kinabatangan Police Station. 

She was sent to Kinabatangan Hospital for medical examination, which confirmed she was 30 to 32 weeks pregnant.

Following the report, at about 4.15pm, a police team from the Criminal Investigation Division of the Kinabatangan District Police Headquarters arrested the man, who had been handed over by a member of the public.

Deputy Public Prosecutor Yuvan Bharathan prosecuted, while the man was unrepresented.

The court ordered the man to be referred to the Immigration Department for deportation.
