Kota Kinabalu: Two individuals were charged tentatively in the Magistrate’s Court, here, on Tuesday with drug trafficking.
Siti Nur Dayana and Md Fahmi Zainal, both in their 20s, who appeared before Magistrate Dzul Elmy Yunus, were accused of trafficking 55.25gm of 3,4 MDMA on Jan 1 this year, at 10am, in a living room of a unit on the 11th floor of Vetro 11, Jalan Penampang here.
The duo were jointly charged under Section 39B(1)(a) of the Dangerous Drugs Act 1952, which carries a punishment of either the death penalty or life imprisonment and whipping with a minimum of 15 strokes.
No plea was recorded from them.
The prosecution applied for another mention date pending the chemists’ report and proposed no bail as the charge against the accused is non-bailable.
Dzul Elmy fixed March 12 for mention and ordered the duo, who were not represented, to be further remanded.
In another case, a 27-year-old man was charged with two counts of possessing stolen properties.
Calvin On, a cook, pleaded not guilty to both charges under Section 411 of the Penal Code.
On the first count, Calvin was accused of keeping a stolen wallet containing personal documents and bank cards belonging to NorSabrina Suib on Jan 5 this year at 3.30pm, in the bushes near Commercial Centre 88.
On the second count, he allegedly kept a stolen laptop and its bag on the same day and time in a rented room above a shop in Commercial Centre 88.
Each charge carries a jail term of between six months and five years and the liability of a fine upon conviction.
The prosecution, in applying for a pre-trial case management date (PTCM), proposed bail of RM4,000 for each charge.
Counsel Lim Ming Zoong, representing Calvin, applied for a lower bail, stating that Calvin works as a cook, is married with one child, and is the sole breadwinner of the family.
The court fixed March 12 for PTCM and released the accused on bail of RM1,700 in two sureties for each charge.
