Woman claims RM40k for unfinished house
TAWAU: A 57-year-old woman has filed a claim totalling RM40,645.50 against a construction contracting company at the Malaysia Consumer Claims Tribunal (TTPM) for failing to complete her house according to schedule.

Mea Monteseran, in her statement of claim, said she engaged Sharon Tom Enterprise to build her house at Payang 1, Lahad Datu, at a cost of RM146,000, with the construction period fixed at six months from June 1, 2024, to November 1, 2024.

However, she said the house was not completed within the agreed timeframe despite her having paid RM115,500 to the company within three months, purportedly for the purchase of tiles, paint, doors and other materials, which to date were never procured.

Mea said her house was left abandoned for one year and one month despite numerous opportunities being given.

After repeated demands, the company allegedly promised to complete the house within two months, from August 1, 2025, to October 1, 2025, but again failed to do so.

She said that during the two-month period, she paid the remaining RM34,500, less a penalty of RM15,200 for nine months, calculated at RM50 per day as stipulated in the agreement in the event the contractor failed to complete the house within six months.

The remaining RM19,300, she said, was used to purchase building materials to continue construction of the house.

Meanwhile, TTPM Sabah president Larina Wong Shiao Yee on Monday adjourned the case to January 22, 2026, for a second hearing and directed both the claimant and the respondent to submit a breakdown of the claim and their respective witnesses.

Earlier, company owner Sharon Santi and company assistant Albert Mangubot disputed the amount claimed, citing financial difficulties faced by their company.

The husband-and-wife duo also said they had intended to complete the claimant’s house but encountered problems when workers allegedly absconded, claiming the claimant frequently changed her mind on the house design plans.
