Kota Kinabalu: A 38-year-old Indonesian charged with two counts of raping his stepdaughter, will go trial.
The man whose case was brought up for sentencing, changed his plea to not guilty to the charges against him.
Sessions Court Judge Noor Hafizah Mohd Salim set Jan 14 for e-review for mention the status of the alleged victim’s official medical report.
On the first count, the man is accused of raping the 13-year-old girl at 7am at the end of February 2018 at a room of a workers quarters in Papar.
On the second count, he allegedly raped the same girl again at the age of 16-years-old, at the same place at 2pm in early December this year.
The offence under Section 376(3) of the Penal Code carries a jail term of between eight and 30 years, and whipping of at least 10 strokes, on conviction.
The man who was not represented, was further remanded.
In another case, a 34-year-old man was ordered to enter his defence on a charge of committing physical sexual harassment against a six-year-old girl.
Sessions Court Judge Azreena Aziz made the order for Azwan Aliasan, after ruling that the prosecution had established a prima facie case against Azwan.
The court set Jan 13 for Azwan’s defence.
Azwan is accused of committing the offence by hugging, and kissing her cheek while undressing her at 10.55am on July 6, 2020 by the roadside in Penampang.
