Kota Kinabalu: A Pakistani national was fined RM10,000 or 12 months’ jail by the Sessions Court here for overstaying in Malaysia for more than two years.
Mursalin Khan pleaded guilty before Sessions Court Judge Hurman Hussain to the charge against him.
Mursalin, who holds Pakistani passport, was found to have remained in Malaysia after the expiry of his Special Pass, which was valid only until Feb 10, 2024.
He was charged with overstaying in the country for two years, three months and 29 days.
The offence was detected at11.45am on June 8 at the front counter of the Special Reference and Compound Unit, Enforcement Division, Sabah Immigration Department, here.
The charge under Section 15(1)(c) of the Immigration Act 1959/63, punishable under Section 15(4) of the same Act, carries a fine of not less than RM10,000, imprisonment of up to five years, or both, on conviction.
Immigration prosecuting officer Mohd Hairul Bona told the court that Mursalin was detained by Immigration officers acting on instructions from the Head of the Enforcement Division.
Investigations revealed that he had overstayed after the expiry of his Special Pass, based on a verification memorandum issued by the Special Reference and Compound Unit of the Sabah Immigration Department dated June 11, 2026.
The court also ordered Mursalin to be referred to the Immigration Department for further action.
Mursalin paid the fine.
