Kota Kinabalu: A 30-year-old man was jailed eight weeks and fined RM1,000 or six weeks’ jail for stealing four cans of beer from a hypermarket.
Masizuan Mumin pleaded guilty before Magistrate Dzul Elmy Yunus to stealing four cans of Carlsberg Special Brew belonging to Bataras Hypermarket Manggatal, at 11.30am on June 12.
The offence under Section 380 of the Penal Code carries a jail term of up to 10 years and a fine, on conviction.
The court heard from the prosecution that a store employee detained Masizuan outside the hypermarket and asked him to open his sling bag.
When inspected, four cans of alcoholic beverages were found inside the bag, which Masizuan had taken out of the hypermarket without paying at the cashier counter.
Masizuan was later handed to police, together with the stolen items, was handed over for further action.
Investigations confirmed that the barcode numbers on the recovered items matched those of the missing goods belonging to the hypermarket.
Unrepresented, Masizuan asked for a lenient sentence, saying he was divorced and had three children.
The court ordered him to serve the jail sentence from the date of his arrest.
Meanwhile, a 41-year-old man was fined RM3,000 or five months’ jail for assisting in the disposal of stolen property.
Dion Daim pleaded guilty to helping remove and conceal a stolen gas cylinder and a 400W LED solar light belonging to one Sim Bee Chin at Inanam Business Centre at about 9pm on June 11.
The offence under Section 414 of the Penal Code carries a jail term of up to seven years, a fine, or both, on conviction.
The prosecution informed the court that the said items were reported missing from a workers’ quarters at Jalan Pan Borneo, Jalan Kionsom, Inanam, on June 11.
Investigations revealed that Dion was occupying the workers’ quarters and that the missing items had last been seen on June 5.
Dion was then arrested by police later on the same day and that the stolen items were recovered, which had been hidden in a bushy area nearby.
Duty counsel Lim Ming Zoong @ Lawrence, representing Dion, asked for leniency, saying his client was married and had two children.
Inspector Mohamad Hamidi Mohamad Hamzah, prosecuting, applied deterrent sentences in both cases.
