Driver fined for death threat against woman
The offence under Section 506 of the Penal Code carries a jail term of up to seven years, or a fine, or both, on conviction.
Kota Kinabalu: A 36-year-old driver was fined RM4,500 or jailed eight months by the Magistrate’s Court here for threatening to kill a woman.

Johnny Roni pleaded guilty before Magistrate Marilyn Kelvin to threatening to kill one  Roney Taipok, at 4.30pm on April 7, this year, in front of a house in Kg Nabangkung, Kobusak, Penampang.

In the charge, Johnny have uttered the words: “Kau naik ikut saya atau saya turun, Brenda Beacham dan jiran kau tu saya kasi mati (You either come with me or I come down; I will kill Brenda Beacham and your neighbour).”

The court heard from the prosecution that the victim was outside her house when Johnny approached her in an angry state and made the threat, causing her to fear for her safety.

The victim then lodged a police report. Johnny was arrested on April 8, at 9.20pm.

In mitigation, counsel Lim Ming Zoong @ Lawrence, representing Johnny, sought a lenient fine, saying Johnny is married with five children and had been remanded for over a month.

Inspector Yusdi Basri prosecuted and a deterrent sentence was sought.

Meanwhile, a 57-year-old man was jailed one day and fined RM2,000 or eight months’ jail for sending threatening messages.

Zulkernain Mohiddin pleaded guilty to criminal intimidation via WhatsApp by sending threatening messages to one Othman Abdullah

on Dec 4, 2024, at a house in Villa Nosoob, Penampang.

In the charge, Zulkernain have sent the message:  “selagi aku belum tgok, kau bermandi kan darah, selagi itu aku ndk selesai. Kau pegang apa yg aku cakap nikau boleh laknat aku sampai bila atau yg sewaktu dgn nya kalau aku ndk buat apa yg sdh ku bagitau kau. Pecah mmg kepala mu tu, (until I see it, you will be drenched in blood, I will not stop… I will smash your head).”

The offence under Section 507 of the Penal Code carries a jail term of up to two years, on conviction.

The court heard from the prosecution that the victim received a series of threatening messages from Zulkernain, who was a former employee, causing fear for his safety and that of his family.

Zulkernain also posted the victim’s photos and screenshots of their conversation on Facebook, making accusations and demanding money over alleged debts.

Investigations revealed Zulkernain was dissatisfied and repeatedly harassed and threatened the victim over the issue.

He was arrested by police in Tawau on Dec 14, 2024.

In mitigation, appointed counsel Lim Ming Zoong @ Lawrence, representing Zulkernain, requested a lenient sentence in the form of a fine, citing that Zulkernain is a pensioner, married with two adult children, and a first-time offender and was the sole breadwinner of his family.

He also suffers from kidney stone complications requiring ongoing treatment, said Lim.
