Kota Kinabalu: A company was fined RM20,000 for operating passenger lifts without a valid certificate issued by an officer from the Department of Occupational Safety and Health (DOSH) or an authorised person.
Sessions Court Judge Amir Shah Amir Hassan imposed the fine on the hotel after its representative pleaded guilty to the charge on Tuesday.

The charge falls under Section 27D(1) of the Occupational Safety and Health Act 1994, punishable under Section 27D(5), which carries a fine of up to RM100,000, a jail term of up to one year, or both, upon conviction.
The court heard that a routine inspection at the hotel found that the certificates for two passenger lifts had expired on Jan 10, 2025.
Further investigations revealed that although the lifts had registration numbers, they were operated without valid certificates from Jan 11, 2025, until Oct 7, 2025.
The lifts are owned by the company.
DOSH Prosecuting Officer Christy Claire De Guzman appeared for the prosecution, while the company was represented by counsel Vanessa Maria Marimuttu.
