Kota Kinabalu: A 37-year-old Pakistani, married to a Malaysian, was fined RM800 or a month’s jail for breaching the condition on his social visit pass by working as a shop assistant in a grocery shop.
Sessions Court Judge Azreena Aziz made the order against Hayat Ullah Sherd Ullah Khan who pleaded guilty, Thursday.
Hayat had violated the social visit pass issued to him as he is married to a Malaysian, Faridah Dais, 54, by working at Mutiara Trading Enterprise. The pass is valid until Aug 25, 2024.
He committed the offence at 9.55pm on June 24 this year in Kuala Manggatal, here.
The offence under Section 39B of the 39(b) Immigration Regulations Act 1963 carries a jail term of up six months, or a fine of up to RM1,000, or both, on conviction.
During mitigation, Hayat asked for leniency.
However, Prosecuting Officers Abdul Lamit from the Immigration Department, urged the court to impose an appropriate sentence.
After paying the fine or serving the jail sentence, the court ordered Hayat to be referred to the Immigration Department for deportation as well as his biometrics data to be recorded.
In the same court, a man who was charged with entering the State illegally, claimed that he possessed a birth certificate.
Fauzi Sazali informed the court that he has the document.
The court fixed July 25 this year for mention.
Pending the date, Fauzi was ordered to be remanded further.
Meanwhile, a man was sentenced to four months’ jail for entering the State without any documents.
Jul Antis who admitted to entering the State illegally, was arrested on June 27 this year in Papar after failing to produce his identification documents to the police.
The court ordered Jul to serve the jail sentence from the date of his arrest and be referred to the Immigration Department for deportation.
