Kota Kinabalu: A Filipino man was charged at the Immigration Court with possessing a fake entry permit.
Jimhar Joseph pleaded not guilty before Sessions Court Judge Herman Hussain to the charge against him.
Jimhar is accused of possessing the fake document at 12.10pm on May 11 this year outside the National Registration Department office in Jalan Sulaman, here.
The offence, under Section 56(1)(l) of the Immigration Act, is punishable under Section 56(1)(aa) of the same Act, which carries a fine of up to RM10,000 or a jail term of up to five years, upon conviction.
The court set June 22 this year for mention and released Jimhar on bail of RM3,000 with two Malaysian sureties.
Jimhar was also ordered to report to the Immigration Enforcement Division office here or in Tawau every two weeks.
Immigration Department prosecuting officer Baxter Junior Goh prosecuted the case, while Jimhar, who is holding an IMM13 document, was represented by counsel Datuk Ram Singh.
In the same court, a 35-year-old Pakistani man was fined a total of RM4,500 for illegal entry and for breaching the conditions of his special pass.
Fawad Ali admitted to both charges against him after they were read to him.
On the first count, Fawad was fined RM4,000, in default four months’ jail, for entering the State without valid documents.
He was arrested at 6.30pm on May 3 this year at Immigration Examination Counter 4 at the Kota Kinabalu International Airport Departure Hall, here.
On the second count, he was ordered to pay another RM500 or serve three months in prison for breaching the conditions of his document, which only allowed him to stay in West Malaysia, but he was found in Sabah.
He was detained at the same place and time.
After paying the fine or serving the jail sentence, Fawad was ordered to be referred to the Immigration Department for further action.
