Kota Kinabalu: Two women were fined a total of RM7,600 for having and selling unregistered products and cosmetics without labels, respectively.
Sessions Court Judge Amir Shah Amir Hassan meted out the fines, Tuesday, to Rasulah Lensu, 43, and Nurfaranah Jouhari, 36, after they pleaded guilty separately to the charges against them.
Rasulah has two charges, while Nurfaranah has three.
On the first count, Rasulah was fined RM800 or seven days’ jail for selling one box of healthcare product which was not registered with the Ministry of Health (MOH) at Sue Beauty in Papar on July 4, 2024.
On the second count, she was ordered to pay another fine of RM2,000 or 14 days’ jail for selling a cosmetics without label at the same place and time.
As for Nurfaranah, on the first count, she was fined RM800 or seven days’ jail for selling two unregistered products at 11.50am on July 4, 2024 at D Sista Gallery in Papar.
On the second count, Nurfaranah was fined RM2,000 or 14 days’ jail for having 12 products which were not registered with MOH at the same place and time.
On the third count, she was ordered to pay RM2,000 or 14 days’ jail for having three cosmetics without notifications at the same place and time.
In mitigation, Rasulah and Nurfaranah, who were not represented, asked for leniency.
However, the prosecution urged the court to impose an appropriate sentence on them on the grounds that the duo had committed the offences which could risk the public’s health as the products were not registered and had no notifications.
The prosecution also submitted that the products were confirmed not registered with the National Pharmaceutical Regulatory Agency (NPRA), lacking evaluation by the Drug Control Authority (DCA), raising concerns about their quality, effectiveness and safety, which may pose risks and side effects to the public.
The prosecution explained that these products’ quality, effectiveness and safety are questionable and those who use the products may face side effects.
