Drugs: Man walks free
He was charged under Section 6 of the Dangerous Drugs Act and punishable under Section 39A(2) of the same Act which provides for a jail of between five years and life imprisonment, and whipping at least 10 strokes, on conviction.
Kota Kinabalu: A man was freed from a charge of having 190.11gm of cannabis, without his defence being called.

Sessions Court Judge Noor Hafizah Mohd Salim discharged and acquitted  Adrian Crnila Kareem after ruling that the prosecution failed to establish a prima facie case.

Adrian was accused of having the drug at 3.30pm on Jan 5, 2022 at a room of a house in Millineum Court, Jalan Lintas, Kepayan, nere here.

He was charged under Section 6 of the Dangerous Drugs Act and punishable under Section 39A(2) of the same Act which provides for a jail of between five years and life imprisonment, and whipping at least 10 strokes, on conviction.

The prosecution had called six witnesses during the hearing.

Initially Adrian was charged under Section 39B of the Dangerous Drugs Act that provides for life imprisonment or death sentence.

However, the charge was reduced to 39A(2) of the same Act.

Deputy Public Prosecutor Atiqa Nazihah Azmi appeared for the prosecution while counsel Bartholomew Jinggulam and Edward Paul defended Adrian.

Meanwhile, 40 people were jailed between three and 10 months by the Immigration Special Court for committing various immigration offences.

Thirty-four of them were Filipinos while the rest were Indonesians aged between 20 and 50.

All pleaded guilty separately before Sessions Court Judge Dana Arabi Wazani. 

Thirty-four were jailed between three and 10 months for entering the State illegally, three were jailed three months each for overstaying in the State after their passes expired while the rest were jailed six months for breaching the conditions of their passports.

Some of them were also ordered to get two strokes of the cane.

All of them were ordered to serve the jail sentence from the date of their arrests.

Prosecuting Officer Abdul Lamit Abdul Manan from the Immigration Department appeared for the prosecution.
