Kota Kinabalu: A 34-year-old man, who damaged his neighbour’s property following a dispute over dog faeces, was on Friday fined RM1,300 or one month’s jail by the Magistrate’s Court.
Agus Susanto Albert pleaded guilty before Magistrate Wan Farrah Farriza Wan Ghazali to committing mischief by damaging a red plastic chair belonging to one Shely Rolda Guevarra outside a house at Kampung Hungab, Penampang, at 10.05am on April 30, causing losses amounting to RM39.

The charge under Section 427 of the Penal Code carries a jail term of not less than one year and not more than five years, or a fine, or both, on conviction.
The court heard from the prosecution that the incident occurred after Agus went to the complainant’s house in an angry state and questioned her over dog faeces found near the area.
However, the complainant informed him that she had already cleaned up after her dog and had also confined the animal, adding that the faeces in question did not belong to her dog.
Despite the explanation, Agus remained dissatisfied and threatened to slap the complainant before the argument was interrupted by a relative.
The court was told that Agus then pushed the complainant, causing her to fall against a sofa.
He also punched the complainant’s door and damaged a red plastic chair belonging to her.
The complainant later attempted to record the incident using her mobile phone, prompting Agus to stop his actions and leave the house.
Fearing for her safety and that of her family, the complainant then lodged a police report for further action.
In another case, a 24-year-old woman was fined RM1,400 or one month’s jail for gambling in a public place.
Pijah Kilah pleaded guilty before Magistrate Marilyn Kelvin to engaging in gambling activities at an open area near a Petronas station in Donggongon town, Penampang, at 4.45pm on Nov 1, 2025.
The charge under Section 7(2) of the Common Gaming Houses Act 1953 provides a fine of up to RM5,000 or imprisonment of up to six months or both, upon conviction.
The law also provides for any gambling equipment or items seized during the offence to be forfeited to the Government.
The prosecution informed the court that a police team conducted an “Op Dadu” operation at the location and found Pijah involved in online top-up gambling activities.
She was detained together with several seized items before being brought to the Penampang police headquarters for further action.
Pijah appealed for a lighter sentence, saying she is the eldest among seven siblings.
The prosecution applied for the forfeiture of RM50 seized during the arrest, which was allowed by the court as Government revenue.
