The charge under Section 323 of the Penal Code read together with Section 34 of the same Code carries a jail term of up to one year or a fine of up to RM2,000 or both, on conviction.
The court heard from the prosecution that the complainant lodged a police report at the Penampang police station at 5.38pm on the same day, claiming he had been assaulted by a group of men who were customers at the club where he worked.
Investigations revealed that the incident started after the complainant threw ice cubes towards the group of men, triggering a confrontation.
The complainant was then assaulted by several men and later sought police assistance.
Police later detained Affendy on Dec 25, 2025, on suspicion of involvement in the assault. Several other men were also brought to the Penampang police headquarters for further action.
Investigations found that the complainant suffered injuries including a cut on his right eyebrow, bruising on his right elbow and swelling on his forehead.
In another case, a 38-year-old woman was fined RM1,400 or one month’s jail for possessing illegal public lottery tickets.
Ernie Kopitan admitted before the same court to having one unlicensed “Wa Hui” public lottery ticket and another ticket containing questions related to illegal lottery activities.
She committed the offence at Restoran Dhazli Nasi Kandar, Indah Permai, Jalan Sepanggar, at 5pm on Feb 9 this year.
The charge under Section 9(1) of the Common Gaming Houses Act 1953 carries a fine of up to RM5,000 or imprisonment of up to six months, on conviction.
The court heard that a police team conducted an operation at the restaurant and found Ernie involved in “Wa Hui” gambling activities.
She was detained and several items were seized during the operation.
Investigations revealed that the seized items were analysed by a gambling expert, who confirmed they were unlicensed “Wa Hui” public lottery tickets and related betting slips printed using a mobile printer.
Police also found that a mobile phone seized from Ernie was used to access an application known as “Menang88”, which enabled users to key in betting numbers purchased by customers.
Ernie, through duty counsel, appealed for a lenient sentence on the grounds that she is a divorcee with five children fully dependent on her.
The prosecution applied for a deterrent sentence and sought forfeiture of RM65 cash seized during the operation.
The court ordered the money to be forfeited to the Government as revenue.
Inspector Yusdi Basri prosecuted.
