Kota Kinabalu: A seller of beauty products with previous convictions for pharmacy-related offences was fined a total of RM5,000 for three charges of illegally possessing poisons for the purpose of sale, possessing unregistered cosmetics, and possessing cosmetics without notification.
Sessions Court Judge Amir Shah Amir Hassan imposed the sentence on Norfarazila Jafran, 26, after she pleaded guilty to all three charges.
On the first count, Norfarazila was fined RM1,500, in default 14 days’ imprisonment, for possessing six products containing poisons, namely Hydroquinone, Tretinoin and Sibutramine, without a valid licence at the FA Beauty kiosk in Bataras, Papar, on March 5, 2024.
The offence, under Section 13(a) of the Poisons Act 1952 and punishable under Section 32(2) of the same Act, provides for a fine of up to RM3,000, or imprisonment of up to one year, or both, upon conviction.
On the second count, she was fined another RM1,500, or 14 days’ imprisonment in default, for possessing eight products that were not registered with the Ministry of Health at the same place and time.
On the third count, Norfarazila was fined RM2,000, in default 14 days in jail, for possessing 18 types of cosmetics without notification at the same place and time.
The court heard that on Dec 8, 2025, Norfarazila had previously been fined a total of RM5,000 for four charges of possessing unregistered products and products without notification.
During mitigation, Norfarazila requested leniency, stating that this was her second offence, which had also occurred on March 5, 2024, but at a different shop location.
She informed the court that her business is still operating and requested to pay the fine in three instalments if a fine were to be imposed.
However, Pharmacy Enforcement Prosecuting Officer Muhammad Zainal Arif urged the court to impose a deterrent sentence.
The prosecution submitted that they had received another complaint involving Norfarazila, alleging that she was still selling the same products, prompting an inspection of the shop.
