Family members punished over child injury case 
The offence under Section 323 of the Penal Code provides for a jail term of up to one year, or a fine of up to RM2,000 or both, upon conviction.
Kota Kinabalu: An 18-year-old boy was placed under good behaviour bond for two years while his father and sister were each fined RM2,000 for causing injury to the boy’s sister who is the fourth siblings in the family.

The father, 43, daughter, 23 and the 18-year-old their pleas and pleaded guilty before Sessions Court Judge Marlina Ibrahim.

The youth was placed under RM2,000 bond undeposited with one local surety. The father and daughter were fined.

They caused injury to the 12-year-old girl at about 1pm on Jan 21 this year at a house in Kampung Mansiang, Manggatal.

Previously, they were charged under Section 31 (1) (a) of the Children Act 2001, punishable under Section 31 (1) of the same Act, read together with Section 34 of the Penal Code for allegedly abused the sister.

If convicted, they are liable to a fine of not more than RM20,000 or a jail term of up to 10 years or both.

However, counsel Lawrence Lim, who represented them, had written a representation letters to the deputy public prosecutor’s office and it was accepted which the previous joint charge were reduced to separate lesser charges.

The father and his children then were discharged and acquitted from the previous charge which then was struck out by the court.
