Cannabis: Hotel worker is freed

He was charged under Section 39B(1)(a) of the Dangerous Drugs Act 1952, and is punishable under Section 39B (2) of the same Act, which carries the death sentence or imprisonment for life and whipping of not less than 15 strokes if not sentenced to death, on conviction.
SANDAKAN: A 31-year-old hotel worker was on Monday freed from a charge of trafficking 1,350.8gm of cannabis three years ago.
High Court Judge Datuk Celestina Stuel Galid discharged and acquitted Mohd Azmie Indra at the end of his defence.

Celestina held that the Court found that the defence had raised a reasonable doubt in the prosecution’s case.
Five prosecution witnesses were called to testify during the trial which commenced on March 21 this year and Azmie, who was ordered to enter his defence on Sept 14, had called six witnesses.
Azmie allegedly committed the offence at 1pm on Feb 8, 2020 at the premises where he worked.

Azmie, who would celebrate his birthday on Nov 28, said he was thankful as he had not been able to be with his family for almost four years and his child was born while he was under remand.
Deputy Public Prosecutor Sofi S. Sawayan prosecuted while Azmie was represented by counsel Hamida Ambo.
