China firm fined RM30,000 over worker’s fatal mishap
The offence under Section 17(1) of the Occupational Safety and Health Act, provides for a fine of up to RM50,000, or a jail term of up to two years, or both, on conviction.
Kota Kinabalu: A China company was fined RM30,000 in default 60 days’ jail for failing to ensure safety on its project site which resulted in a fatal incident of a worker.

Sessions Court Judge Noor Hafizah Mohd Salim ordered China Railway Engineering Corporation (Sabah) Sdn Bhd to pay the fine after its safety and health officer pleaded guilty.

The company failed to ensure safety and health of workers as the company did not install safe electrical equipment which caused fatal incident to Sisal Ramlie, 30.

The offence took place between 7.30pm and 8pm on April 28, last year at the fifth floor of a room near a lobby lift of the Proposed High Rise Condominiums site project in Jalan Bundusan, Penampang.

The offence under Section 17(1) of the Occupational Safety and Health Act, provides for a fine of up to RM50,000, or a jail term of up to two years, or both, on conviction.

Meanwhile, two of the company’s sub-contractors were fined RM8,000 each for  failing to ensure the safety, health and welfare of Sisal by not installing safe electrical equipment (lamp extension cable) at the same place and time.

The sub-contractors were IIS Controls Sdn Bhd and Fiberlink Solutions Sdn Bhd which were represented by its directors. They pleaded guilty before Sessions Court Judge Amir Shah Amir Hassan.

During mitigation, the representatives asked for leniency as it was the company’s first offence.

However, Prosecuting Officer Elisa Eligius Samuel of the Department of Occupational Safety and Health urged the court to hand down a deterrent sentence as a warning to other would-be offenders.
