Raping girl, 7: Timorese charged
The offence under Section 376(2)(e) of the Penal Code carries a jail term of between 10 and 30 years, and whipping, on conviction. The court set Oct 27 this year for pre-trial case management and no bail was offered to the man following an objection by the prosecution.
Kota Kinabalu: A 51-year-old Timorese was charged with raping a seven-year-old girl who was under his care.

The Indonesian who is married to a Dusun, pleaded not guilty before Sessions Court Judge Elsie Primus, to the charge against him on Tuesday.

The man is accused of raping the girl between 9am and 6pm in 2018 at an oil palm estate in Jalan Marak Parak, Kota Marudu.

The offence under Section 376(2)(e) of the Penal Code carries a jail term of between 10 and 30 years, and whipping, on conviction. The court set Oct 27 this year for pre-trial case management and no bail was offered to the man following an objection by the prosecution.

Earlier, Deputy Public Prosecutor Mas Izzaty Lokman objected to bail the man on the grounds that the man was the caretaker of the minor.

Mas Izzaty informed the court that the alleged victim is currently under the care of the Welfare Department.

The man asked for bail and informed the court he did not commit the offence. He also told the court that he is holding a passport and secured by his wife.

The wife, who was present in court, was later asked by the court on whether she knew why her husband was in court in which the wife answered she did not know.

After being given explanation by the court that her husband was charged with raping a minor, the wife broke down in tears.

The case was stood down for several minutes and continued with counsel Jecky Lettong who helped the man on pro-bono basis, informed the court that he had spoken to the wife and her daughter on the bail. Jecky said so far no instruction to apply for bail yet.

In another case, a 69-year-old man claimed trial to committing physical sexual harassment against a girl.

Liew Nyuk Lin allegedly committed the offence against the 12-year-old girl by touching her private part at 6.30am on April 22 this year by the roadside in Jalan Nountun Kolombong, Inanam.

The court set Oct 27 for pre-trial case management and Liew was released on a bail of RM10,000 with RM5,000 deposited in two local sureties with several additional conditions.

Liew, who was not represented, was ordered to report to Inanam police station every month and not to tamper with the prosecution witnesses.

The court also ordered the man to move to his daughter’s house as the current house where he was staying in is one kilometre from the alleged victim’s place.
