15 years for causing death

Kota Kinabalu: A 20-year-old man was sentenced to 15 years' jail for causing the death of a Filipino.Sessions Court Judge handed the sentence to Mohd Faizal Johari after he pleaded guilty, Wednesday, to committing culpable homicide not amounting to a murder of Madzmin Sampang, 22, between 7pm and 10pm on Aug 8, 2017 in front of Syarikat Meibau Enterprise in Taman Tanjong Kapor, Kudat.

The offence under Section 304(a) of the Penal Code carries a jail term of up to 30 years, and liability to a fine, on conviction.

The court ordered Mohd Faizal to serve the jail sentence from the date of his arrest.

Mohd Faizal, who was not represented, asked for a light sentence saying that he came from a poor family and that his mother is already old.

However, Deputy Public Prosecutor Hafizah Zahidah Abdullah urged the court to impose a deterrent sentence on the grounds that it was a serious offence in which the life of person was taken due to Mohd Faizal's act.

The court heard that the Kudat police headquarters received a call from the Kudat Hospital informing that a man without identification document suffered serious injury on his back.

The hospital informed police that the man, later identified as Madzmin, could not make it due to serious injuries and was pronounced dead at 3.45pm on Aug 9, 2017.

Mohd Faizal was arrested thereafter and further investigations revealed that he stabbed Madzmin with a knife.
