The offence under Section 39B(1)(a) of the Dangerous Drugs Act, read together with Section 34 of the Penal Code, carries life imprisonment or death sentence, and whipping of at least 15 strokes, on conviction.
TAWAU: Two men were sentenced to death by the High Court here Wednesday for trafficking 4,091.7gm of syabu two years ago.

Judge Datuk Duncan Sikodol meted out the sentence to Fung Kim Loong, 42, and Sirman Abdullah, 32, after ruling that the prosecution has proven its case beyond reasonable doubt against the duo.

Fung and Sirman were found guilty of trafficking the drugs at 3.55pm on June 14, 2022 at Bandar Sri Indah, here.

The offence under Section 39B(1)(a) of the Dangerous Drugs Act, read together with Section 34 of the Penal Code, carries life imprisonment or death sentence, and whipping of at least 15 strokes, on conviction.

Earlier, counsel Ram Singh who defended the duo requested for life imprisonment to be imposed on them, saying both accused were known to each other.

Ram further said the duo were innocent carriers and did not have the intention to traffic the drugs and that it was their first offence.

However, Deputy Public Prosecutor Hurman Hussain said the death penalty was an appropriate sentence as drug trafficking nowadays was very rampant, adding that the drugs weighed more than 4.9kg.
