Fire cert: Beaufort hypermarket, hotel fined
The offence under Section 33 of the Fire Services Act 1988 provides for a fine of up to RM50,000 or jail term of up to five years or both, on conviction.
Kota Kinabalu: A hypermarket and a hotel in Beaufort were fined RM3,000 each by the Sessions’ Court for failing to obtain a fire certificate from the Fire and Rescue Department.

CNF Hypermarket Sdn Bhd and Jasaria Hotel, which were represented by the same representative, were ordered to pay the fine or two months jail on each charge after pleading guilty before Judge Noor Hafizah Mohd Salim.

CNF Hypermarket had committed the offence at Block L, Beaufort Jaya Phase 2, Commercial Development on Aug 3, 2020 while the hotel had committed the offence at Block K in the same area at 9am also on Aug 3, the same year.

The offence under Section 33 of the Fire Services Act 1988 provides for a fine of up to RM50,000 or jail term of up to five years or both, on conviction.

The representative pleaded for leniency by saying that business was not good after the Covid-19 pandemic.

He added that the hypermarket was unable to survive and has not been operating since Sept 1, this year.

Prosecuting officer, Mohammad Akramin Sakirun applied for a deterrent sentence as well as a lesson to the public.

The fines were paid.

Meanwhile, in the Magistrate’s Court, a 36-year-old man was fined RM3,000 or 10 months jail for theft.

Labouer Mohd Azlie Soon Abdullah pleaded guilty before Magistrate Stephanie Sherron Abbie to stealing two rolls of cable belonging to the ITCC Penampang management, at 7.56am on Oct 29 at the ITCC Mall.

The charge under Section 379 of the Penal Code carries a jail term of up to seven years or fine or both, on conviction.

The court was informed by the prosecution that the complainant lodged a police report stating that about 30 metres of ground cable at the open space on the roof of the building was stolen and suffered a loss of about RM3,000.

CCTV footage found three individual, believed to be contractors, who were employed to do repair works at ITCC, looked suspicious carrying an empty sack up to the roof on Oct 28 and came down without the sack and was seen going up to the roof on Oct 29 and brought down a sack full of  things to a vehicle.

Police, acting on information, arrested Azlie at Taman Telipok Ria on Oct 30 and the cables were found with him.
