Minister’s brother faces death row

Kota Kinabalu: The 49-year-old brother of Federal Minister Tan Sri Noh Omar claimed trial in the High Court here, Thursday, for trafficking in 82.71gm of syabu. He faces death if convicted.Mohd Jusnaidi Omar pleaded not guilty before Judge Datuk Nurchaya Haji Arshad to committing the offence at 8.30pm on Nov. 27, 2019 at the Kota Kinabalu International Airport’s police station.

This is the second time Jusnaidi is being charged with drug trafficking under section 39B (1) (a) of the Dangerous Drugs Act 1952.
He was acquitted and discharged by the High Court here on a charge of Trafficking in 1.011kg of cannabis at the Low Cost carrier terminal in Tg Aru at 10am on May 20, 2007.
Eight years later on Sept. 1 2016, Jusnaidi was jailed five years by the Sessions Court for causing hurt by shooting a mechanic with a pistol at 5pm on May 6, 2015, at a premises along Jalan Tuaran bypass, under Section 324 of the Penal Code.
In the latest case, Jusnaidi was charged under Section 39B(1)(a) of the Dangerous Drugs Act 1952. The charge is punishable under Section 39B (2) of the same Act which carries the death penalty or imprisonment for life and whipping not less than 15 strokes if not sentenced to death on conviction.

Assigned counsel Timothy Daut, representing Jusnaidi put on record that Ram Singh and Kamarudin Mohamad Chinki were senior counsel that he would seek supervisory instruction and/or advice.
Nurchaya set Nov 26 for the first pre-trial case management and ordered Jusnaidi to be further remanded pending the date as the charge against him had no provision for bail.

Meanwhile, the case of a 21-year-old Filipino charged with a similar offence has been adjourned to Oct 13.

Timothy, who was the assigned counsel for Pillah informed the court that the accused’s family member had appointed another counsel, Azhier Farhan to represent him and that he would write an official letter to the court regarding the matter.
