Cheating: Woman gets 18 years

Kota Kinabalu: A 31-year-old local woman was jailed a total of 18 years on six counts of cheating amounting to RM8,400 over the purchase of Projek Perumahan Rakyat homes at Meruntum in Putatan.Fairieza D'Souza Mohd Firdaus changed her plea and admitted to cheating one Khalid Azmi, one Irene Simon, one Doris Ignatius, one Rasidah Ajidikeh, one Abdul Majid Taman and one Lester Justin that she is managing the sale of the PPR homes, causing them to give her RM1,400 each as downpayment for the purchase of the houses.

She had committed the offence between May 25, 2015 and June 23 the same year at several restaurants in Putatan, in Penampang and at the construction site of the housing project.

Fairieza was charged under Section 420 of the Penal Code which provides for a jail term of between one and 10 years, and whipping and fine, on conviction.

Magistrate Jessica Ombou Kakayun sentenced Fairieza to three years' jail on each count and ordered her to serve the sentence concurrently.

Earlier, counsel Azhier Farhan Arisin, representing Fairieza, requested for leniency saying Fairieza, who came from a poor family, is married with two children and supporting a 21-year-old disabled brother.

He said Fairieza was a victim of circumstances where she only received the money on the instruction of one Nurie Azzarina Noor Abdullah, who was also charged with a similar offence, for a small commission.

Fairieza was remorseful over her action, said Azhier, who added that the money as in the two counts had been confiscated by the police.

Meanwhile, a man, Ngu Kiong Pui claimed trial to cheating by pretending to be some other person.

Ngu is accused of cheating a person into believing he was one Cathy Teo in a handphone transaction, causing the person to credit RM980 into Teo's bank account.

He allegedly committed the offence framed under Section 416 of the Penal Code, at 3.35pm on Dec 28, 2015 in Sadong Jaya.

Counsel Arthur Borine, representing Ngu informed the court that the complainant had actually withdrawn the police report he made and that the defence would write a representation letter to the DPP's office for the case to be withdrawn.

Jessica set July 12 for mention of the case and released Ngu on a bail of RM1,300 in two sureties.

Inspector Azaman Hamat appeared for the prosecution.
