Two men get 22 years, 10 strokes each for robbery

Kota Kinabalu: Two men were jailed a total of 22 years plus 10 strokes of the cane each on two counts of robbing two men with swords.Mohammad Izauddin Mohammad Huzir, 30, and Mohamad Shahrizal Hussien, 23, pleaded guilty separately before Sessions Court Judge Amir Shah Amir Hassan, Thursday.

On the first count, the duo was each sentenced to 10 years and ordered to get five strokes of the cane for robbing Md Danish Akmal Md Faizal of his IPhone 11 and cash at 12.05am on March 23 this year at Restoran Rasta BGR Gloxinia, Kinarut, Papar.
On the second count, they were jailed 12 years plus five strokes of the cane each for robbing Mohammad Harif Palma of a handphone at the same place and time.
During the incident, the duo had respectively used swords.
The court ordered the duo to serve the jail sentence concurrently from Thursday.

They committed the offence under Section 395/397 of the Penal Code which provides for a jail term of up to 20 years, and whipping, on conviction.
During mitigation, both of them asked for leniency.

However, Deputy Public Prosecutor Najihah Farhana Che Awang urged the court to hand down a deterrent sentence due to the rampancy of such cases and that the incident had traumatised the victims.
The court heard that the incident occurred while the victims were about to close the restaurant. The two men who covered their faces with masks entered the restaurant with swords.
One of the man, later identified as Mohammad Izauddin, went to the counter and asked Md Danish to surrender the cash as well as his IPhone.
Meanwhile, the other man identified as Mohamad Shahrizal, who had pointed the sword towards Mohammad Harif. He also took Mohammad Harif’s hanpdhone.
After committing the offence, the duo fled the scene in a vehicle.
The duo were arrested following a police report lodged by the victims.
Md Danish and Mohammad Harif had identified the face masks, swords, clothes and vehicle used by the duo while committing the offence.
