Eatery cashier jailed for theft
Each offence under Section 380 of the Penal Code carries a jail term of up to 10 years and liability of a fine, on conviction.
Kota Kinabalu: A former cashier of a restaurant was jailed a total of 10 months by the Magistrate’s Court here on three counts of stealing RM1,638.20 from the premises.

Filipina Hanisah Utal, 38, pleaded guilty before Magistrate Stephanie Sherron Abbie to committing the offences at the Mee Ngar Restaurant in Telipok last year.

On the first count, Hanisah was jailed three months  and fined RM1,400 or one month jail on the first count of stealing RM461 on Dec 16, 2023, at 2.28pm.

Hanisah on the second count, was also jailed three months and fined RM1,400 or a month’s jail for stealing RM546.20 on Dec 17, the same year at 10.42am.

On the third count, she was jailed for four months and fined RM1,500 or a month’s jail for stealing another RM631 on Dec 18, the same year, at 1.22pm.

Each offence under Section 380 of the Penal Code carries a jail term of up to 10 years and liability of a fine, on conviction.

The court heard from the prosecution that the restaurant owner lodged a police report against Hanisah, who was the cashier, after she was found taking the company’s money daily without the employer’s knowledge.

Hanisah’s act was caught on CCTV, said the prosecution.

Hanisah, who was not represented, requested a lenient sentence to be run concurrently.

The court ordered her to serve the imprisonment sentence from the date of her arrest and to be referred to the Immigration Department thereafter.

In another Magistrate’s Court case, a man was fined RM4,000 or six months jail for disposing of a stolen computer tablet.

Ajos Assan admitted to committing the offence on a stolen Samsung Galaxy Tab on Oct 25, 2021, at 9am, at a shop in Kg Numbak here.

The charge under Section 414 of the Penal Code carries a jail term of up to seven years or fine or both, on conviction.

The prosecution informed the court that the gadget was reported stolen from a house in Kg Kuala Manggatal on Oct 25, 2021.

Deputy Public Prosecutor Ling Guong Zhin and Inspector Navind Kumar Vijayan prosecuted.
