Businessman, a ‘Geng Upik’ member, files bail application
Charged under Section 130V(1) of the Penal Code, which carries a jail term of between five years and 20 years on conviction, the 13 were ordered to be further remanded pending next mention of their case on March 22.
Kota Kinabalu: A 46-year-old businessman, who was among 13 individuals charged with being members of the organised crime group “Geng Upik”, filed a bail application at the High Court here.

Nelson Yen Yee Chung’s application was mention on Tuesday before Judicial Commissioner Datuk Faridz Gohim Abdullah.

Faridz fixed May 6 for decision.

The court also directed the respondent (the prosecution) to file affidavit on or before April 12, and reply by the applicant on or before April 19, written submissions to be filed simultaneously on or before April 26 and reply, if any on, or before May 3.

Yen and 12 others - Rahman Burijin, 44; Jaisalfian Jaineh @ Zaini, 45; Mohd Fauzie Rablin, 33; Shahlan Shah Abdul Samad, 37; Datuk Maslan Sani, 41; Mohd Faridzul Asmahadi, 31; Fazrul Bahar, 32; Alkan Abraham, 35; Mazlan Mahmud, 41; Mahathir Jibarail, 49; Norsyafilah Pawawoi, 27, and Zulkahar Dusing, 38 were previously charged separately at the Sessions Court to committing the offence from 2015 to 2023.

No plea was taken from them as their plea would only be recorded once their case being transferred to the High Court.

Earlier, in Tuesday’s proceedings at the High Court, counsel Datuk Ram Singh representing Yen, informed the court that the notice of motion and the affidavit had been served by courier to the Putrajaya on March 5 and also a copy of it to Attorney General’s Chambers Branch Sabah, on the same day.

Ram noted that the Deputy Public Prosecutor (DPP) handling the case is from the Attorney General’s Chambers, Putrajaya and sought direction from the court whether parties could submit and reply the affidavit together.

DPP Afiq Agoes, who was standing in for DPP Lina Hanini Ismail, applied for a month’s adjournment as the DPP in charge needs to reply the affidavit and to arrange with Prison Department for medical a check-up of the applicant.
