Another two members of Geng Upik charged

Kota Kinabalu: Two more individuals were charged in the Sessions Court,  Friday, with being members of the organised crime group “Geng Upik” from 2015 to 2023.

Norsyafilah Pawawoi, 27, and Zulkahar Dusing, 38, were separately brought before Judge Noor Hafizah Mohd Salim to face the charge under Section 130V (1) of the Penal Code.

Norsyafilah and Zulkahar were accused of committing the crime between 2015 and July 28, 2016; and between 2021 and May 3, 2023, here, respectively.

However, no plea was taken from them. They were not represented.

The prosecution informed the court that Norsyafilah is currently serving 12 years jail since 2016 for a drug trafficking offence under Section 39B of the Dangerous Drugs Act 1952 while Zulkahar has been remanded under the same Act since 2022.

The court set March 22  to transfer the case to the High Court.

Earlier, the other 11 individuals, including a ‘Datuk’, facing similar charge, will have their case mentioned again on March 22 for their cases to be transferred to the High Court.

The 11 were Rahman Burijin, 44; Jaisalfian Jaineh @ Zaini, 45; Mohd Fauzie Rablin, 33; Shahlan Shah Abdul Samad, 37; Datuk Maslan Sani, 41; Nelson Yen Yee Chung, 46; Mohd Faridzul Asmahadi, 31; Fazrul Bahar, 32; Alkan Abraham, 35; Mazlan Mahmud, 41; and Mahathir Jibarail, 49.

They were charged separately in committing the offence from 2015 until Dec 24, last year.

Their plea would only be recorded in the High Court.

Section 130V(1) of the Penal Code carries a jail term of between five years and 20 years, on conviction.

Earlier, the prosecution informed the court that Friday’s mention to submit documents to the defence parties but was not ready and applied for a date on April 15 onwards if allowed.

The parties also have not yet received a common date for the consent to transfer the case to the High Court, said the prosecution.

Counsel for all accused, except Rahman and Aklan, objected to the date as it is too long as the accused has been detained since December last year and applied for an early mention date.

Deputy Public Prosecutors Lina Hanini Ismail and Siti Hajar Mat Radzi prosecuted.

Jaisalfian was represented by counsel Muhamad Amirul Amin, Fauzie and Mazlan were represented by counsel Sylyester Kuan, while Shahlan, Faridzul and Mahathir were defended by counsel Shahlan Jufri, Mohd Luqman Syazwan and Luke Ressa Balang.

Maslan and Fazrul were represented by counsel Chin Tek Ming and Batholomew Jingulam, Nelson was represented by counsel Datuk Ram Singh, Kamarudin Mohmad Chinki and Chen Wen Jye.

Earlier, Chin informed the court that counsel Tan Sri Shafee Abdullah would conduct the case.
