Nitespot caretaker fined for operating beyond permitted time
She had committed an offence under Section 4(1) of the Public Entertainment Ordinance 1958 which is punishable under Section 11 of the same Ordinance that provides for a fine of up to RM5,000 or up to one year or both, on conviction.
Kota Kinabalu: An entertainment outlet caretaker was fined RM3,000 or three months jail by the Magistrate’s Court for operating beyond the permitted time.

Alvia Sundang, 32, pleaded guilty before Magistrate Lovely Natasha Charles to committing the offence at Mynex Bar at KK Taipan, Inanam, at 2.30am, on Feb 21.

The court was informed by the prosecution that a police team went to the premises and found it still operating with loud music with customers inside.

Investigations revealed that Alvia had breached the condition of the premises’ licence.

She had committed an offence under Section 4(1) of the Public Entertainment Ordinance 1958 which is punishable under Section 11 of the same Ordinance that provides for a fine of up to RM5,000 or up to one year or both, on conviction.

Duty counsel Carmen Khoo, representing Alvia requested a lower fine as she was remorseful and had family commitments.

In another case, two women were fined for engaging in a gambling session.

Kevina Fify, 27, was ordered by Magistrate Lovely to pay a fine of RM2,000 or two months jail for having two lottery tickets at 3.40pm on Jan 24 at a shop in Inanam New Township.

Azlin Ting, 22, was fined RM1,000 or a month’s jail by Magistrate Stephanie Sherron Abbie for engaging in online gambling session in public at 3.30pm on Feb 5 at Plaza Manggatal.

Kevina was charged under Section 9(1) of the Common Gaming House Act 1953 which provides for a fine of up to RM5,000 or up to six months, while Azlin was charged under Section 7(2) of the same Act, which also carries the same penalty.

Meanwhile, a lorry conductor claimed trial for trespassing into someone else’s house.

Shamril Abdullah allegedly committed the offence at Kg Inanam Laut, Inanam, at 5.10am on Feb 28.

Charged under Section 448 of the Penal Code, Shamril was offered bail at RM2,000 in two sureties pending the mention of his case on April 29.
