Victim’s son unaware his father remarried
The eight accused arriving at the Tawau High Court for the murder trial.
TAWAU: The son of a murdered e-hailing driver told the Tawau High Court, Wednesday, he did not know that one of the causes of his late father’s death was a debt involving the latter’s ex-wife.

Mohd Norazrie Nurman, 36, also did not know that his late father married another while in Lahad Datu after divorcing his mother, after he finished Form Five.

The assistant manager at a Tongod estate also told the court he did not know his late father had come to a nightclub and seized his ex-wife’s mobile phone, a few days before he died.

He also did not know the name of his late father’s ex-wife and whether the Myvi found with his father’s body was the car the victim used while living in Lahad Datu.

Mohd Norazrie, the sixth witness for the prosecution, was cross-examined by counsel Abdul Gani Zelika on the second day of the murder trial of e-hailing driver Nurman Bakaratu, 61, involving eight accused, including senior Esscom officers and police.

Proceeding before Tawau High Court Judge Datuk Duncan Sikodol saw four more witnesses testify, including Tawau District Police Chief ACP Jasmin Hussin.

Mohd Norazrie, during examination-in-chief by Deputy Public Prosecutor (TPR) Mohammad Fakhrurrazi Ahmad, said the process of identifying the body of his late father was based on the special characteristics of the deceased’s body.

The witness said he was asked to come to Tawau Hospital by investigating officer ASP Yusman Syahri Marinsah for the purpose of identifying his father’s body.

He said at first he could not identify because the body was bloated.

However, there was a special feature on his father’s body – a right big toe that had damage at the tip.

He added his father had only one kidney and this was confirmed after the post-mortem process.

The accused, former Esscom Chief of Intelligence Staff, SAC Datuk Mat Zaki Md Zain, 58, faces two charges of abetting with six other accused - Rosdi Kastam, 44, Dennis Ak Anit, 44, Fabian Runggam, 43, Khairul Azman Bakar, 47, Mohd Azlan Sakaran, 39, and Vivien Fabian, 34, to murder the victim in a palm oil plantation near Jalan Anjur Juara, Jalan Apas Batu 5 between 7.30 - 11.30pm on Jan 13, 2023.

Mat Zaki was also accused of abetting John Kennedy Sanggah for the murder of the victim at the same time and location.

He was charged under Section 109 of the Penal Code read with Section 302 of the Penal Code, which carries a death sentence or imprisonment of up to 40 years and caning not more than 12 times, if convicted.

The other seven accused were charged under Section 302 of the Penal Code read with Section 34 of the same Act, which carries the death penalty or imprisonment of up to 40 years and can be whipped not more than 12 times, if convicted.

The prosecution was led by Deputy Public Prosecutor (DPP) Khairul Azreem Mamat with his team consisting of DPPs Rohaiza Abd Rahman, Lina Hanini Ismail, Mohammad Fakhrurrazi Ahmad and Low Win Hui.

Rosdi was represented by counsel Datuk Ansari Abdullah and Erveena Ansari, Dennis (Hairul V. Othman and Luke Ressa Balang), Fabian (Sharata Masyaroh John, Ridwan Lincon, Zahbia Ophent and Mohamad Zairi Zainal Abidin).

Vivien, John, Khairul Azman, Datuk Mat Zaki and Mohd Azlan were represented by Datuk Ram Singh and Kamarudin Mohmad Chinki.
