Man jailed for assaulting adoptive dad
John was charged under Section 323 of the Penal Code which carries a jail term of up to a year or fine of up to RM2,000 or both, on conviction.
Kota Kinabalu: A 34-year-old man, who assaulted his 83-year-old adoptive father, was sentenced to six months jail by the Magistrate’s Court here on Tuesday.

Self-employed John Chong pleaded guilty before Magistrate Lovely Natasha Charles to voluntarily causing hurt to Chong Yun Fah on April 22, this year at 6pm in Kg Nabangkung, Penampang.

The court was informed by the prosecution that on the said day, Chong was assaulted by his adopted son, John, and was pushed until he fell into a water-filled ditch.

John behaved in that manner because he thought Chong had hidden his identity card, the court heard.

John was arrested by the police on April 23 following a report filed by Chong’s 58-year-old son accusing him of the offence.

Unrepresented, John requested a lenient sentence and asked for it to be counted from the date of his arrest, as he wished to be released as soon as possible in order to be with his father and apologise to him.

When asked by the court why he hurt the victim, John replied that it was his first time acting in that manner as he could not stand it because he was the one who had paid all the shop’s debts.

Inspector Kelvan Elson Maik, prosecuting applied for a deterrent sentence.

John was charged under Section 323 of the Penal Code which carries a jail term of up to a year or fine of up to RM2,000 or both, on conviction.

In another case, a 46-year-old unemployed man was charged with tentatively trafficking 62.35gm of syabu.

Samuel Chua Soon Heng allegedly committed the offence on June 17, this year at 8.30pm, in the yard of a house at Kg Tatahan, Jalan Kionsom, Inanam.

However, no plea was taken from Chua after the charge under Section 39B(1)(a) of the Dangerous Drugs Act 1952, was read out to him, as his plea would only be recorded in the High Court once his case was transferred to the High Court.

The charge against Chua carries a punishment of either the death penalty or life in prison and whipping with a minimum of 15 strokes, on conviction.

The court set Aug 12 for mention and ordered Chua to be further remanded as the charge against him has no provision for bail.

Meanwhile, a labourer was jailed two months for trespassing on housing construction site.

Bucoi Ahmad, 26, admitted to committing the offence at the PRIMA construction site, behind the Sepanggar Customs housing, on April 12 at 11.48am. 

The offence under Section 447 of the Penal Code carries a jail term of up to six months or fine of up to RM3,000 or both on conviction.

Bucoi, who was undocumented, was ordered to be referred to the Immigration Department after serving his sentence.
