Factory worker fined RM2,000 over Bakakuks

Kota Kinabalu: A 25-year-old factory worker was on Friday fined RM2,000 or two months jail for illegally having two Bakakuks (homemade shotgun) and ammunitions without a licence.

Bede Tambayang pleaded guilty before Magistrate Stephanie Sherron Abbie to having the shotguns, two bullets and one shell casing without a valid licence on June 19 at 3.30pm, in a house at Kg Sarapung, Kolopis, Penampang.

Bede was jointly accused with Michael Linsung, 32, with committing the offence under Section 8 of the Arms Act 1960, which carries a jail term of up to seven years or a fine of up to RM10,000 of both, on conviction.

Michael, a gardener, however, claimed trial to the charge.

The court fixed July 11 for mention of Michael’s case and released him on a bail of RM1,000.

In Bede’s case, the facts of the case presented by the prosecution, stated that police discovered the weapons after Michael was admitted to the hospital with a gunshot wound on his back, sustained while hunting wild animals with Bede in a forest area in Penampang.

Bede transported Michael to the hospital for treatment.

Duty counsel Lim Ming Zoong @ Lawrence, representing Bede, requested a lenient sentence as it was his first offence and he works as a factory worker.

In Michael’s case, the prosecution had earlier proposed bail at RM6,000.

Duty counsel Lim, who also represented Michael, applied for a lower bail as he is married with three children and works as a gardener.

In another case, two men were jailed eight months each for taking syabu.

Pulalon Abdulhan and Norman Ahmad admitted to committing the offence under Section 15(1) of the Dangerous Drugs Act.

The charge provides for a fine of up to RM5,000 or up to two years jail on conviction.

The court ordered Pulalon and Norman to serve the sentence from the date of their arrest.

Pulalon was also ordered to be referred to the Immigration Department thereafter.
