Drug trafficking: Trio freed

Kota Kinabalu: Three men were freed by the High Court from the charges of trafficking in cannabis.

Judge Datuk Dr Lim Hock Leng discharged and acquitted Annuar Azmi, Hasrani Aliamid and Mahadan Majid, all 27, after ruling that the defence succeeded in raising a reasonable doubt on Thursday.

The trio were freed at the end of the trial.

Annuar was accused of trafficking 495.2 gm of cannabis at 9.27am on May 15, 2020 in front of Pejabat POS Laju KKIP Timur, Manggatal, here.

The offence under Section 39B(1)(a) of the Dangerous Drugs Act 1952 (Act 234) and punishable under Section 39B(2) of the same Act, carries the death sentence, whipping and conviction.

Meanwhile, Hasrani and Mahadan were accused of trafficking 488.2gm of cannabis at 9.30am on the same day in a vehicle parked in front of Pejabat POS Laju KKIP Timur, Manggatal, here.

The duo were jointly charge under Section 39B(1)(a) of the Dangerous Drugs Act 1952 (Act 234) and punishable under Section 39B(2) of the same Act, read together with Section 34 of the Penal Code.

Eight prosecution and three defence witnesses were called during the hearing.

Deputy Public Prosecutor Dacia Jane Romanus prosecuted while counsel Dominic Chew defended the duo.
