Two army personnel deny concealing evidence

TAWAU: Two army personnel, one of them an officer, were charged with with hiding evidence in a fatal accident case.

Leftenant Colonel Werar Suleiman Ali, 55, and Corporal Muhammad Hafizuddin Ripin, 29, pleaded not guilty before Magistrate Don Stiwin Malanjum.

They were jointly charge with the intention to hide the evidences to protect the exhibits of the accident, which was a motorcycle, and from being investigated under Section 41(1) of the Road Transport Act 1987. They allegedly committed the offence at 6pm on Jan 30, 2023 at a petrol station in Mile 3 Jalan Apas, here.

The offence under Section 201/34 of the Penal Code carries a jail term of up to three years, and liable to a fine, on conviction.

The court set July 31 for case management and allowed them bail of RM3,500 in two local sureties for each of them.

Deputy Public Prosecutor Hurman Hussain and Traffic Prosecuting Officer ASP Joan Lee who appeared for the prosecution, suggested bail of RM5,000 with sureties for the duo.

However,  counsel Abdul Gani Zelika who defended Werar and Vivian Thien for Hafizuddin, asked for the bail amount to be reduced on the grounds that thier clients are government servants and that there was no risk they would run away.
