Drink-driving: Man jailed and fined

Yusuf committed the offence at 2.15am on Jan 18, this year, along Jalan Nasalim, here. He committed the offence under Section 45A (1) of the Road Transport Act 1987 (Amended 2020), which carries a jail term of up to two years, and fine of up to RM30,000, on conviction.
SANDAKAN: A 30-year-old man was jailed two days and fined RM10,000 or five months’ jail for driving while under the influence of alcohol.
Magistrate Nur Faezah Jafry meted out the sentence to Yusuf Muksan after he admitted to the charge against him.

The court also ordered Yusuf’s driving license to be suspended for two years.

During mitigation, Yusuf who was not represented, asked for leniency.

However, Prosecuting Officer Rodi Anak Wong urged the court to impose an appropriate sentence to give a lesson to Yusuf and awareness to those driving while under the influence of alcohol.
He added that a heavy sentence should be given to deter future accidents involving drink driving.

The court heard that Yusuf was detained when the police at the said road was moving a vehicle involved in an accident.
The police then stopped Yusuf when he was speeding to avoid the police team.
When a breath test was conducted on Yusuf, it was found that the alcohol on his blood exceeded the permitted limit.
Yusuf did not pay the fine and served the five months’ jail.
