Government servant fined RM852k, jailed
The offence under Section 23(1) of the Malaysian Anti-Corruption Commission (MACC) Act 2009 is punishable under Section 24 of the same Act which provides for a jail term of up to 20 years, and a fine of not less than five times the amount involved or RM10,000, whichever is higher.
Kota Kinabalu: A 42-year-old government servant was fined a total of RM852,000 and jailed 30 years on 30 counts of using his position to award supply jobs to Cure and Care Rehabilitation Centre (CCRC) in Papar to his own company.

Sessions Court Judge Jason Juga meted out the sentence to Mohd Syamsul Jikan after ruling that the prosecution had proven its case beyond reasonable doubt against the accused. 

On the first to 30 counts, Mohd Syamsul was jailed one year and fined between RM10,000 and RM62,000 for each count.

The court also ordered Mohd Syamsul to serve the jail sentence concurrently.

The court allowed Mohd Syamsul’s application to stay execution of the imprisonment and the payment of fine pending appeal to the High Court against the sentence.

On the first to 30 counts, Mohd Syamsul was found guilty of using his position by submitting quotations from his company, Syarikat Emmy Stationary, to supply items to the centre.

He committed the offences between January and October 2015 at the CCRC Office in Jalan Papar-Beaufort.

The prosecution had called 19 witnesses in the hearing and one defence witness.

Deputy Public Prosecutor Franklin Ganggam Bennet appeared for the prosecution while counsel Hamid Ismail represented Mohd Syamsul.
