Jail for recording women bathing
The offences took place on June 6 at 8.04pm, June 7 at 10.09pm and June 11 at 8.24pm, respectively.
Kota Kinabalu: An Indonesian labourer was jailed a total of 54 months on Thursday on three counts of insulting the modesty of three women by secretly recording them in the shower with a handphone.

Herman, 45, pleaded guilty before Magistrate Stephanie Sherron Abbie to committing the offences against the three women, intruding in their privacy in a bathroom of a rented unit at Block A, Sinsuran Complex.

The offences took place on June 6 at 8.04pm, June 7 at 10.09pm and June 11 at 8.24pm, respectively.

Herman was jailed 18 months on each charge.

He was charged under Section 509 of the Penal Code which carries a jail term of up to five years or fine or both, on conviction.

According to the prosecution, Herman was arrested by police following a report by one of the victims’ husband who was informed by his wife that a tenant had recorded female tenants bathing in the bathroom.

The complainant confronted the man, later identified as Herman, checked his handphone, and found recordings of female tenants, including his wife, bathing.

Police investigations revealed that Herman had recorded three female victims taking shower.

The victims were traumatised and embarrassed by Herman’s actions, the court heard.

Unrepresented, Herman requested a lenient sentence. Inspector Suzie S.K. applied for a deterrent sentence.

The court ordered Herman to serve the sentence concurrently and be referred to the Immigration Department after serving his sentence.

In another case, a 63-year-old man was charged with threatening to injure his sister-in-law.

Hassan Ombok claimed trial to committing the offence towards  Alimah Osman, 58, on March 30 at 6pm, Kg Mansiang, Manggatal.

The charge under Section 506 of the Penal Code carries a jail term of up to seven years or fine or both, on conviction.

The court set July 12 for pre-trial case management and released the accused, who was represented by counsel Saban Sawayan, on a bail of RM1,500 in two sureties.

Meanwhile, a salesman was fined RM800 or a month’s jail for having gambling paraphernalia.

Mohd Shafiq Iqbal admitted to purchasing two  lottery ticket slips without a licence at 3.10pm on May 27, at a premises in Bandaran Berjaya.

The court heard from the prosecution that Shafiq was arrested by police during an ‘Op Dadu’ for committing the offence.

Shafiq was charged under Section 9(1) of the Common Gaming House Act which provides for a fine of up to RM5,000 or up to six months jail or both, on conviction.
