Trader, firm fined for selling uncertified walkie-talkie, adapters 
The offence under Regulation 16(1)(b) of the Communication and Multimedia (Technical Standards) 2000 is punishable under Regulation 37 of the Communication and Multimedia Act which provides for a fine of up to RM300,000 or a jail term of up to three years, or both.
Kota Kinabalu: A trader and his company were fined a total of RM5,500 for selling five units of walkie-talkie and six wireless adapters which were not certified by the Standards and Industrial Research Institute of Malaysia (Sirim).

Sessions Court Judge Amir Shah Amir Hassan meted out the sentence to Director Jimmy Hee Chin Yong and his company East Gadgetry Sdn Bhd, after pleading guilty to the charge.

Hee was fined RM2,500 or three months’ jail for selling walkie-talkie and wireless adapters without Sirim certification as required by the Communications and Multimedia (Technical Standards) Regulations 2000. 

His company was also ordered to pay a fine of RM3,000 in default warrant in levy for committing a similar offence at its premises in Lorong Lintas Plaza 2, Jalan Lintas, here, at 1.20pm on Oct 11, 2023.

The offence under Regulation 16(1)(b) of the Communication and Multimedia (Technical Standards) 2000 is punishable under Regulation 37 of the Communication and Multimedia Act which provides for a fine of up to RM300,000 or a jail term of up to three years, or both.

During mitigation, Hee requested for a minimum fine only saying that his company is having financial problem and that the products involved only earned a little profit.

Hee also promised to ensure that his company would sell genuine products.

The prosecution urged the court to hand down an appropriate sentence as to give a lesson to Hee and others.

In the same court, another man was fined RM2,500 or spend three months in prison for selling two units of walkie talkie without Sirim.

Ko Yin Lung admitted to selling the communication equipment that was not certified by Sirim at 11.30am on Oct 11, 2023 at the Ifix Gadget Store in Sinsuran Complex, here.

Prosecuting Officer Nazrul Nizam and Nazilah Idris from Malaysian Communications and Multimedia Commission (MCMC) appeared for the prosecution.
