Fake papers: Two foreigners jailed

Kota Kinabalu: The Magistrate’s Court here Wednesday jailed two foreigners 18 months each for having fake MyKad as their identification documents.

Magistrate Stephanie Sherron Abbie meted out the sentence to Herman Umar, 36, and Haninah Tanis, 48, after they pleaded guilty separately to committing the offence under Section 25(1) (e) of the National Registration Regulation 1990 (Amended 2007).

Herman admitted to having a fake MyKad bearing the serial number 880819-12-6175 under his name on May 28 at 3pm at the Identification Card Division, National Registration Department (NRD) here.

Haninah admitted to having a fake identity card bearing the serial number 760515-12-6246 under her name, also at the same place on May 29, at 11am.

The charge carries a jail term of up to three years or fine of up to RM20,000 or both on conviction.

In Herman’s case, NRD prosecuting officer Mohd Naser Mohd Nadzeri informed the court that he was found to have submitted the said document for verification.

Herman was then arrested when a check by the Department revealed that the MyKad he possessed was not on the NRD’s records.

A check on Herman’s thumbprints also found that they did not match any records in the Department.

Meanwhile, in Haninah’s case, she was there to check the status of her temporary resident identification card application.

Investigations revealed that Haninah had a case related to a complaint from the Malaysian Department of Insolvency, Kota Kinabalu branch, dated June 4, 2019, which was sent to the NRD for further action against Haninah for using a fake identification card.

The Investigation and Enforcement Division of the NRD Sabah found that Haninah possessed a temporary identification card receipt (MyKas) under her name and a search also revealed she had a fake MyKad under her name, which was found in a bag in her car.

Further investigation also found that Haninah possessed a birth certificate with an Undetermined (Non-Citizen) status as her identification document.

Further investigation by the NRD Sabah Identification Card Division and a check of Haninah’s thumbprints found that the Mykad number 760515-12-6246 referred to Haninah.

However, the status in the department’s records for that identification number was Temporary Resident and not Citizen, as stated on the identification card she possessed, said the prosecution.

During mitigation, both requested to be fined only.

Herman said he needed to look after his ageing parents while Haninah said she works as a gardener.

The court ordered Herman and Haninah to serve the sentences from the date of their respective date of arrest and to be referred to the Immigration Department thereafter.
