Labuan Member of Parliament’s suit struck out: Suspension of Bersatu membership

Suhaili filed the suit on Dec 19, 2023 due to Bersatu’s decision on Nov 7, 2023 to suspend his membership in the party for six years.
Kota Kinabalu: The High Court here struck out Labuan MP Datuk Dr Suhaili Abdul Rahman’s suit against Parti Pribumi Bersatu Malaysia (Bersatu) Secretary-General Datuk Seri Hamzah Zainuddin for suspending his party membership.
Judge Datuk Ismail Brahim, in his ruling via Zoom Wednesday, allowed Hamzah’s application to strike out Suhaili’s writ and statement of claim on the ground that the High Court in Sabah and Sarawak has no jurisdiction over Hamzah in respect of the subject matter of the claim and reliefs sought in the action.

The court struck out the action with cost of RM5,000 subject to payment of allocatur.
Suhaili filed the suit on Dec 19, 2023 due to Bersatu’s decision on Nov 7, 2023 to suspend his membership in the party for six years.
In the action, Suhaili was seeking a declaration that he had been deprived of his expectation as a member of Bersatu, a full refund of his life membership fee paid to Bersatu, or damages, punitive damages and exemplary damages.
Meanwhile, in Hamzah’s application, his counsel stated in a written submission that he (Hamzah) had met the conditions in sub-sections (a), (b) and (c) in Section 23(1) of the Courts of Judicature Act 1964.

Thus, it was the High Court in Malaya which has the jurisdiction to hear the suit.
Hamzah was represented by counsel Hamid Ismail and Nabila Norsahar, while Suhaili was represented by counsel Syed Anwar Shariff Abdullah.
