Sexual act on niece: Man charged
The offence under Section 14(a) of the Sexual Offences Against Children Act 2017 provides for a jail term of up to 20 years and whipping, on conviction.
Kota Kinabalu: A 33-year-old man was charged with committing physical sexual harassment against his niece.

The man pleaded not guilty before Sessions Court Judge Amir Shah Amir Hassan, to two charges against him.

On the first count, the man is accused of committing the offence by asking the nine-year-old girl to perform oral sex on him at 10pm in June 2023 at a house in a village in Ranau.

On the second count, he allegedly committed the offence by asking the same girl to hold his private parts at the same place and time.

The offence under Section 14(a) of the Sexual Offences Against Children Act 2017 provides for a jail term of up to 20 years and whipping, on conviction.

The court set June 26 for case management and offered the man bail of RM10,000 with RM5,000 deposited in two local sureties.

The court also imposed several additional conditions, namely the man was reminded not to contact or disturb the alleged victim or prosecution’s witnesses in this case, to surrender his passport (if any) to the court pending trial, to report himself to the nearest police station to place of residence (Balai Polis Ranau) on every first day of the month until disposal of trial.

Deputy Public Prosecutor Suriyati Jumain appeared for the prosecution while the man was not represented.

In another court, a 39-year-old jobless charged with committing physical sexual harassment against an eight-year-old girl, will go trial on Dec 19-20 this year.

The court set the date for Jaiman Keminlian who maintained his plea of not guilty to the charge against him.

He is accused of committing the offence by touching any part of the girl’s body at a house in Likas on Jan 16 this year.

The prosecution told the court that they would call six witnesses during the hearing.

The court also fixed Nov 20 to serve a new copy of documents as Jaiman said the old copy was missing.

Jaiman was further remanded pending the disposal of his case.
