Six overstaying Chinese fined

The offence under Section 15(1)(c) of the Immigration Act 1959/63 which carries a fine of at least RM10,000, or a jail term of up to five years, or both, on conviction for staying in Malaysia beyond the period allowed.
Kota Kinabalu: Six men from China were fined RM10,000 or spend 60 days in prison each for staying in the State after their passports had expired.
They were Bai Huiyong, 47, Cheng Jianbin, 56, Hui Dongjie, 33, Li Shuanghe, 51, Zhang Weijian, 48, and Wu Yufei, 41.

All of them pleaded guilty before Sessions Court Judge Noor Hafizah Mohd Salim, after the charge was read to them in Mandarin.
They were arrested on March 15 at 12.02am at the workers’ quarters of Benyuan Overseas Sdn Bhd at the Projek SBH Kibing New Materials, Industrial Zone 7 in KKIP, here.

The six were found to have overstayed in the State after their passes expired between 10 days and a month.

After paying the fine or serving the sentence, the six were ordered referred to the Immigration Department.
The court ordered the original passports to be return to prosecution for further action.

During mitigation, counsel Lawrence Lim who represented the six, asked for a minimum fine.
He informed the court the six had been detained for 55 days and this had served as a lesson.
However, Prosecuting Office Abu Sopian Karate from the Immigration Department urged the court to hand down an appropriate sentence.
