Civil servant’s appeal dismissed
The offence took place at 2.40pm on Aug 3, 2012 at Bandar Baru Mju, mile 3, Sandakan. The charge was framed under Section 17(a) of the Malaysian Anti-Corruption Commission Act.
Kota Kinabalu: A government servant, who was sentenced to 18 months’ jail and RM30,000 fine for corruption failed in his appeal against his sentence.

Court of Appeal Justices Datuk Supang Lian, Datuk Collin Lawrence Sequerah and Datuk Wong Kian Kheong unanimously dismissed the appeal of Mohd Rithwan Mohd Salleh, 43, ruling that there was no merit in it.

“We find the sentence imposed by the Sessions Court Judge is appropriate and just. The appeal against sentence is dismissed and the order imposed by the High Court is affirmed,” held the court.

The court earlier held that it was satisfied that the conviction was safe and dismissed the appeal against conviction and affirmed the Sessions Court’s decision, which was affirmed by the High Court.

Counsel Datuk Ram Singh, representing Rithwan earlier informed the court of withdrawing the appeal against conviction and proceeded with the appeal against the sentence.

Rithwan, who obtained a stay of execution, was ordered to serve the sentence, as it was his final appeal.

He was on June 22, 2016 sentenced to 18 months jail and RM30,000 fine or six months by the Sessions Court after he was found guilty of the offence.

Rithwan was found guilty of the charge as an Immigration officer attached to the Sandakan Immigration Office, had corruptly tried to obtain for himself, a bribe of RM6,000 cash from one Lee Shuk Wei as an inducement to close the case without taking action to court against Lee who was suspected of committing an offence under Section 55B of the Immigration Act.

The offence took place at 2.40pm on Aug 3, 2012 at Bandar Baru Mju, mile 3, Sandakan. The charge was framed under Section 17(a) of the Malaysian Anti-Corruption Commission Act.

The High Court on July 21, 2020 dismissed his appeal.

Together with Ram was counsel Chen Wen Jye while Deputy Public Prosecutor Sarulatha Paramavathar appeared for the prosecution as respondent.
