Graft: MKN officer fined

TAWAU: A Diplomatic Administration Officer (PTD) was fined RM15,000 or five months jail by the Special Corruption Court, here, Monday for abusing his position to obtain bribes five years ago.

Mohaidy Tabin, 45, who works at the National Security Council (MKN) pleaded guilty before Judge Jason Juga to the alternative charge offered to him by the prosecution. 

The charge stated that Mohaidy as Head of the Branch and Chairman of the Quotation Committee at the Malaysian Insolvency Department Office, Tawau Branch, used his position to obtain bribes by selecting his wife, Faizah Noor Fauzi, 42, as the successful bidder in the Quotation for the Toyota Fortuner 2.7V worth RM15,000.

Mohaidy committed the offence at the Malaysian Insolvency Department Office Tawau Branch on Oct 18, 2018.

The charge under Section 26 of the Malaysian Anti-Corruption Commission (ASPRM) Act 2009 provides for a fine of not more than RM50,000 or imprisonment of not more than seven years or both, if convicted.

Counsel Safrin Salleh applied for a lenient sentence as he still has to support his parents and his children are still in school.

Mohaidy has been a loyal civil servant since 2001 and has provided the best possible cooperation throughout the investigation of his case, said Safrin.

MACC prosecuting officer Rekraj Singh pressed for a deterrent sentence as a lesson to him.

“The prosecution does not believe that the accused cooperated with the MACC, however, in this case, the accused as Branch Head should show example and integrity in carrying out his duties,” said Rekraj.

He added that even though Mohandy only faced one charge, the court needed to take into account the seriousness of the case, not to mention the case of abuse of power is a current issue.

“These cases of misuse of power will create a perception of lack of public confidence in civil servants,” he said.
